Terms & Conditions in full

These Terms & Conditions ("Terms") govern all bookings and services provided by Mara Tours & Travel Ltd ("Mara", "we", "us"). By making an enquiry or booking, you accept these Terms. These Terms are governed by the laws of the Republic of Kenya and, where applicable, the Consumer Protection Act, 2012 and the Tourism Act, 2011.
Section 01Booking & Confirmation
A booking is confirmed only upon receipt of the required deposit (typically 30%) and our written confirmation. The balance is payable no later than thirty (30) days before travel unless otherwise agreed in writing.
Section 02Prices & Payment
Prices are quoted in Kenyan Shillings (KES) or United States Dollars (USD) and are subject to change until confirmed in writing. Accepted payment methods include M-PESA, Visa, Mastercard, PayPal and bank transfer. All bank charges are borne by the client.
Section 03Amendments by Client
Requests to amend a confirmed booking must be made in writing. We will use reasonable efforts to accommodate them subject to availability. Supplier fees, fare differences and an administration fee may apply.
Section 04Amendments & Cancellations by Mara
We reserve the right to alter any itinerary due to force majeure, safety, weather, government directives, park closures or supplier failure. Where a material change occurs we will offer a comparable alternative or a refund of unused services.
Section 05Traveller Responsibilities
- Ensure a valid passport (with 6+ months validity), Kenya eTA where required, and any medical clearances
- Arrive on time for transfers and activities
- Observe park regulations, cultural norms and local laws
- Purchase adequate personal travel insurance (strongly recommended)
Section 06Insurance
Mara does not sell travel insurance. Clients are strongly advised to obtain comprehensive travel, medical and cancellation cover before travel.
Section 07Liability
Mara acts as an intermediary between clients and independent suppliers (hotels, lodges, airlines, transporters, guides). Our liability for any single booking shall not exceed the total amount paid to us for that booking, except where liability cannot be limited under Kenyan law.
Section 08Complaints
Any complaint must be raised with us in-country during travel so we can address it, and confirmed in writing within 28 days of the end of the trip.
Section 09Governing Law & Disputes
These Terms are governed by Kenyan law. Any dispute shall first be referred to good-faith negotiation, then to mediation under the Nairobi Centre for International Arbitration, and finally to the courts of Kenya sitting in Nairobi.
